Federal Court Orders Release of Abrego Garcia from Immigration Detention

A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment lacks lawful basis.

"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her ruling.

The case stems from a mistaken removal to El Salvador earlier this year, which US authorities later admitted was an mistake. After his repatriation to the United States to answer alien smuggling charges, he was detained in immigration custody.

In her order, the judge pointed out that the government does not have a current removal order, which prevents them from removing Mr. Abrego Garcia "at this time."

Context of the Legal Challenge

The legal challenge involve disputed assertions. While the Trump administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this claim.

He has also pleaded not guilty to the conspiracy charges, which are part of a separate criminal case in the state of Tennessee.

The court, who was overseeing his challenge to removal in a Maryland district court, determined that he must now comply with the terms of his release from jail in Tennessee. This decision shifts his monitoring to the Tennessee court.
